Read this first. When you use LiveQue, you take on 100% of the risk. We are not at fault for anything. It does not matter who you are. By signing up, you agree that you do so entirely at your own risk, not ours. If you are not comfortable with that, do not use LiveQue.
LiveQue is run by Glen Irvin and Isaac Irvin. It lets a performer publish a list of songs they play, and lets people in the room request one and optionally send the performer a tip. These terms cover both performers and the people making requests. If you do not agree to them, please do not use LiveQue.
LiveQue is a technology platform. We are not your employer, your agent, your partner, or your booking company. We do not select, approve, or supervise performers, and we are not a party to anything agreed between a performer and a venue or between a performer and an audience member.
You decide what you play. A tip can move a request higher in a performer's queue. It never obliges a performer to play anything. Performers may skip, reorder, or delete any request for any reason.
Payment processing on LiveQue is provided by Stripe. A tip is charged to the payer by LiveQue and transferred to your own connected Stripe account, from which Stripe pays it out to your bank. We do not retain any part of a tip: LiveQue currently charges performers no platform fee and takes no percentage. Card processing fees charged by Stripe still apply, and we pass that cost through so that you receive the amount shown to the payer. Our current fees, if any, are the ones shown on our website at the time of the transaction.
We may introduce or change fees. LiveQue is free to performers today. We reserve the right, at our sole discretion, to introduce a platform fee, to change or increase any fee, to change how a fee is calculated, and to charge for features that are currently free.
How much notice you get. If we introduce a new fee that applies to you, or increase an existing one, we will tell you at least 30 days before it takes effect, by email to the address on your account and by notice in the app. If you keep using LiveQue on or after the effective date, you accept it. If you would rather not, you may close your account at any time before then, owe us nothing, and withdraw any available balance.
Nothing is retroactive. A new or increased fee applies only to tips processed on or after its effective date. It is never applied to tips already processed or to funds already credited to you.
Processing fees are not ours. Card processing fees are charged by our payment processor, set by that processor and not by LiveQue, and passed through.
Changes to the service itself are different. Features are not fees. We may add, change, suspend, limit or remove any feature of LiveQue at any time, with or without notice, and we may discontinue the service entirely. We are two people building this around our own gigs and we need to be able to move quickly.
Payment processing services for performers on LiveQue are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these terms or continuing to operate as a performer on LiveQue, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of LiveQue enabling payment processing services through Stripe, you agree to provide LiveQue accurate and complete information about you and your business, and you authorize LiveQue to share it and transaction information related to your use of the payment processing services provided by Stripe.
You must keep your Stripe account in good standing. If Stripe restricts or closes your account, we cannot process tips for you.
If someone who tipped you disputes the charge with their bank, that money is taken back, along with a fee the card network charges us.
As a performer, you are responsible for tips that are later disputed, refunded, or reversed. You authorize LiveQue and Stripe to reverse the corresponding transfer from your connected account, and to debit your connected account or its linked bank account, to recover the disputed amount and any associated fee. If those funds cannot be recovered automatically, you agree to repay the amount on request.
A tip pays a working musician for a service they perform. You are at a venue, a performer is playing, and you are paying them for that performance and for taking your request. LiveQue is not a way to send money between friends, and it may not be used for that.
A tip is voluntary. It is not the purchase of a guaranteed performance of a particular song: it moves your request up the performer's list, and the performer decides what they play.
How the money moves. Your card is charged by LiveQue, and the payment is transferred to the performer's own Stripe account, from which it is paid out to their bank. LiveQue keeps none of it. We pass Stripe's card processing cost through so that the performer receives the amount shown on the screen when you paid.

Because a tip pays for a performance rather than a specific song, we will not usually refund simply because a performer chose not to play your request. That is the performer's call, and the tip still paid for the set they played.
Refunds are issued through Stripe to the card you paid with, normally within 5 to 10 business days. Where we refund a tip that has already been transferred, we may recover it from the performer under section 3.
Do not use LiveQue to harass anyone, to send threatening or abusive messages through the request or notes fields, to impersonate another performer, to launder money, or to break the law. Do not attempt to scrape the service, interfere with it, gain unauthorised access to it, or copy it for the purpose of building a competing product. We may suspend or close any account that does.
The LiveQue name, the software, and the design are ours. Using LiveQue does not give you any right to copy, reproduce, reverse engineer, or redistribute it, or to build a derivative product from it. Your song list, your name, and your content remain yours, and you give us only the permission needed to display them to the audience at your gig.
LiveQue is provided “as is.” We do not promise it will be uninterrupted, error free, or available during any particular gig. Venues have bad signal. Phones die. Please do not build your night around us being perfect.
To the fullest extent permitted by law, LiveQue and its founders are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost tips, or lost opportunities.
Our total liability to you for any claim relating to LiveQue is limited to the greater of the total fees you paid us in the twelve months before the claim, or one hundred US dollars.
We would much rather sort a problem out by email than by lawyers. Please contact us first.
Nothing in these terms requires arbitration of, or waives your right to bring in court, a claim alleging sexual assault or sexual harassment, consistent with the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (9 U.S.C. §§ 401–402). Whether that Act applies is for a court to decide.
Nothing in these terms waives any right to seek public injunctive relief where that waiver would be unenforceable.
If any part of these terms is found unenforceable, the rest still applies.
You can stop using LiveQue at any time and ask us to delete your account. We may suspend or close an account that breaches these terms. If we close your account, any tips already settled to your Stripe account remain yours.
We may change these terms. We reserve the right to modify, add to, or remove any part of these terms at our sole discretion, including the fee provisions in section 2.
Minor changes. Corrections, clarifications, new features and changes required by law take effect when we post them here and update the date at the top.
Material changes. If a change materially affects your rights or what you pay, we will give you at least 30 days notice before it takes effect, by email to the address on your account and by notice in the app. The updated terms will be posted here throughout that period so you can read them before deciding.
Your choice. If you keep using LiveQue on or after the effective date, you accept the changed terms. If you would rather not, you may stop using LiveQue and close your account at any time before that date, at no cost, and withdraw any available balance.
Prospective only. All changes apply going forward. No change applies to any transaction completed, or to any dispute that arose, before its effective date.
The one exception. We may make a change effective immediately, without advance notice, only where it (a) is required by law, by our payment processor, or by a card network, (b) responds to a security, fraud or abuse risk, or (c) adds an optional feature or otherwise does not reduce your rights or increase what you pay.
We will act reasonably and in good faith when we exercise the rights in this section.
